Albemarle County Divorce Decree vs. Certificate

Two offices handle different types of Albemarle County divorce records. Knowing which one you need makes the process faster.

The Circuit Court Clerk holds final divorce decrees and case files. A final decree is the court order that ended the marriage. It contains the full terms of the settlement including property division under § 20-107.3, any spousal support under § 20-107.1, and if children were involved, custody and support orders under § 20-108.2. The first certified copy of the decree is free to the named parties under § 17.1-275.

The Virginia Department of Health issues divorce certificates. A certificate is a shorter document that simply confirms a divorce occurred. It shows the names, date, and place. VDH has records from 1918 forward. The fee is $12 per copy under § 32.1-272. For Albemarle County, you can also request certificates through the Thomas Jefferson Health District office in Charlottesville.

The Thomas Jefferson Health District office is located at 1138 Rose Hill Drive, Charlottesville, VA 22903. Phone: (434) 972-6200. This local office can provide divorce certificates without you having to travel to Richmond. Hours vary so call ahead before visiting.

Who Can Access Albemarle Divorce Records

Albemarle County divorce records are restricted under Virginia Code § 32.1-271. They are not open to the general public. Only the parties named in the record and their immediate family members may request copies.

Immediate family members who qualify include parents, spouses, children, siblings, and grandparents. Extended relatives like aunts, uncles, and cousins cannot request these records. Each eligible requester must show a valid government-issued photo ID. The ID must be enough to confirm who you are and your relationship to the parties in the record.

The 25-year rule changes things. Under § 32.1-271, divorce records become public once 25 years have passed since the divorce was granted. At that point, anyone can request copies. Records sealed by court order under § 20-121.4 are an exception. Sealed records stay restricted even after the 25-year period expires, though the named parties and their attorneys can still access them.

Virginia's grounds for divorce are set out in § 20-91. They include adultery, felony conviction with over a year of confinement, cruelty or reasonable apprehension of bodily harm, and willful desertion or abandonment. The most common route is no-fault, which requires the parties to live separate and apart without cohabitation for at least one year. That period drops to six months when there are no minor children and both parties have signed a separation agreement.
